Being open source has never helped a commercial product to increase its users base. Never. If you want open source with Pascal you already have FPC and Lazarus. You need open sources features ? Contribute to these projects. You want new features in Delphi IDE ? You have the Open Tools API. If Delphi were open sourced, what will you do to help it "not to die" ?

That's a tricky one and it only happens on non-English keyboard settings. When you set your keyboard to English the shortcut will always work because it is hard-wired in the keyboard interface. Also the behavior is different depending on the keyboard layout: RSP-30422 - Toggle Comment Line works different depending on keystroke used Although this problem exists since quite a time, we were not able to detect the trigger for that. Well, it is sufficient to open the editor context menu to make it work again.

There are several new tickets in Embarcadero's quality portal regarding reFind. Your issue is described here: QP - refind mangles rename units. Let's hope they will fix it asap. BTW - It has not been fixed in D13 September Patch...

No. That would just give them an excuse to never add the feature back again. And MMX is not a replacement for the functionality provided by refactoring - had it actually worked.

Try removing/disabling the refactoride*.bpl package in the IDE's "Known IDE Packages" Registry key.
